Boost Gymwear Terms and Conditions

LIABILITY 

Boost Apparel CC trading as Boost Gymwear does not accept liability for any loss or damages caused by this website, or any website linked to this website. 
Boost Apparel CC Reserves the right to refuse or cancel an order at anytime without giving reason. We will make all reasonable effort to contact the customer using the details provided and all received monies will be refunded using the method received. 

ORDERING METHOD 

Boost Gymwear’s website offers on-line purchasing. Orders via phone, fax or email will also be accepted.

Please note any orders placed during our ANNUAL CLOTHING INDUSTRY SHUTDOWN PERIOD, which is 3 weeks over the Dec/Jan Xmas period, can only be produced after opening in January.  These orders CANNOT be eligible for Cancellation or a Refund due to a long lead time.  

CURRENCY USED 

"By using our website, you (the visitor) agree to allow third parties to process your IP address, in order to determine your location for the purpose of currency conversion. You also agree to have that currency stored in a session cookie in your browser (a temporary cookie which gets automatically removed when you close your browser). We do this in order for the selected currency to remain selected and consistent when browsing our website so that the prices can convert to your (the visitor) local currency." 

All prices are quoted in South African Rand and converted into United States Dollars for foreign orders.
VAT (Value Added Tax).
All domestic customers and deliveries will be subject to VAT.

SHIPPING RATES   

Boost Gymwear will publish or display the current shipping rates on the websites as applicable.
Shipping rates may vary or be waived as part of promotions or sales on the website and the part or fully discounted shipping may cease at any time at the discretion of Boost Gymwear.
Boost Gymwear reserves the right to change any or all of the following, at any time:
-Shipping rates charged to any destination; 
-Delivery method;
-Carrier or shipping provider.

SHIPPING WITHIN SOUTH AFRICA

Orders for delivery within South Africa are normally dispatched via the SA Post Office and usually arrive within 3 - 5 business days from dispatch.
Standard Shipping rates for deliveries within South Africa vary from R50.00 to R150.00 depending on size and weight of parcel.

NO REFUNDS ON ANY SALE ITEMS

It is the clients responsibility to track and follow up on delivery once we send a tracking number and fulfil your order.  We do not do refunds for Courier Delays.  If there is a Courier Delay we need to be notified by the client along the way.  

SHIPPING OUTSIDE OF SOUTH AFRICA

Online orders for delivery outside of South Africa are dispatched via Courier and should usually arrive within 7 - 10 business days from dispatch.  Couriers are not able to deliver to PO Box addresses, when placing your order please provide a physical address. 
Standard Shipping rates will be quoted on at time of order. 
Boost Gymwear does not accept any responsibility for customs delays, duties or taxes that may apply; these will solely be the responsibility of the purchaser.
By confirming a purchase you are accepting responsibility for all Customs Charges incurred.  Boost Gymwear wishes to remind you that as the importer of goods you are legally responsible for any and all taxes, duties, and charges by your Government. 
Boost Gymwear does not have any control over customs charges and are unable to advise what they will be, as it is based on your own countries regulations and compliances.  If you are concerned about what charges you may be liable for, please check with your local customs office before proceeding to checkout.  All charges are to be paid by the customer on delivery of order. Under no circumstance will Boost Gymwear accept any orders back due to rejection of customs charges. Orders cannot be returned to sender.

DISPATCH OF ORDERS 

Orders are normally dispatched within 1-3 business days of Order Confirmation subject to all ordered items being in stock or longer for custom made orders.
If any items cannot be fulfilled from your order we will contact you via email.

  • If you do not query non delivery within 28 days from receipt of the tracking number, then you will deemed to have received your order. 
  • No claims after 28 days will be considered. 

ACCEPTANCE OF GOODS

On receiving the order the customer is responsible for inspecting the goods for fault or damage. 
Should the items ordered not be of acceptable quality, it is the customer’s responsibility to notify Boost Apparel CC, as soon as possible. Please see Returns & Exchanges Policy for more information.

Boost Gymwear reserves the right to amend any Branding on the Advertised Garment without notice, unless it changes the look and feel of the garment (ie:  if the Branding is the not the main feature of a plain garment).  That is if the advertised Branding has been discontinued or sold out.  

SALE ITEMS - NO Sale items can be returned for any refund or credit.  Any replacements on sale items need to be confirmed and discussed with management in writing and will only be allowed when reasonable with prior agreement. 

PRICING

Boost Apparel CC reserves the right to change prices without notice. 

GIFT VOUCHERS

In order to redeem any voucher, you must return the original thereof to us. Lost vouchers will not under any circumstances be honored.

Please note that gift vouchers cannot be used in conjunction with any other discount codes or special offers.  Gift Vouchers can only be redeemed for Products sold at Full Retail Selling Price and all shipping charges must be paid in addition to any voucher. 

RETURNS OR EXCHANGES

We want you to love what you ordered! You can return or exchange any unworn, unwashed or defective merchandise within 7 days of purchase. Returns made within 7 days of purchase in original unworn, unwashed condition with all labels attached will be refunded to the original form of payment within 7 days of return. Refunds of delivery charges will not apply and you will have to cover the risk and costs of returning the item to us, unless confirmed by Management in writing.

Any Products that have been CUSTOM ordered, lengthened, shortened, altered or made up to any specific measurement is at the clients risk and can not be returned or refunded.

Since we do not charge for Custom Appointments and Custom Fitting (even in person at the Studio) any Problems with Shortening where the client "may need to further shorten" is at their cost just like any product from any other Retailer, unless by prior confirmation from Management in writing. 

SALE ITEMS - NO Sale items cannot be returned for refund or credit.

Our Free Shortening Service is considered a Custom Fit.  Boost Gymwear cannot be responsible for incorrect client specs provided, or where a new fabric made up could react differently to the sample fitted and measured. No returns can be made for incorrect measurements provided by the client or taken for the client.

BOOST GYMWEAR, c/o POSTNET, WILLIAM ROAD (AT THE SPAR), NORWOOD, 2192, JHB - please forward tracking number so we can follow up from our side.

Boost Gymwear reserves the right to determine whether a product is faulty and conduct a production and quality check. If deemed faulty by Boost Gymwear a replacement item will be shipped where possible subject to stock availability or a credit note issued. A response for Faulty Claims will be received within 48 hours of the garments arrival at the Boost Gymwear Head Office.

PLEASE NOTE:
a) Boost Gymwear will not be held responsible if there is a delay in delivery.
b) Customers will be responsible for the return shipping and handling charge.
c) For faulty or damaged goods, please include a copy of your postage receipt. If the product is deemed faulty after review we will then credit the cost of postage back to you.
d) You need to send the original or a copy of receipt with you order.
e) In the event that your product is lost in transit, Boost Gymwear will not be held liable and therefore recommends that you send all returns via Register Post.
f) We ask that you allow 7 business days from the day your return your package for your account to be credited.

SAMPLES

All Samples are charged at FULL RETAIL SELLING PRICE.

Anyone found to have copied or produce a version of any of our styles will be severely dealt with by our Legal Team. 

All samples loaned for a meeting or presentation can only be kept for a maximum of 2-3 days and need to be returned in full salable condition, otherwise they will be charged at Full Retail Selling Price.  

No samples will be credited against a bulk order.  

WASHING RETURNS & INSTRUCTIONS

Please note Washing Instructions for all our Garments are strictly as follows:

COLD WASH ALWAYS!  COLD WASH ALWAYS! 

NOTE:  ANY HEAT OR HOT WATER ON LYCRA IS GOING TO: 

A) SHRINK THE ITEM 

B) UNSETTLE THE COLOURS INITIALLY WHICH MAY CAUSE COLOUR RUNS 

HAND WASH IS ALWAYS PREFERABLE - especially the first 3 times of a new garment to settle all the colours.

Where an item has more than one colour, this item definitely has to be washed in cold water separately and hand washed for the first 3 washes.  Please note Boost Gymwear will not take any responsibility for any colour runs if the garment is washed any other way where the item contains more than one colour.  

Please note:  ALL NEON SHADES have to have cold water and wash separately washes.  Neons worldwide take time to settle their shades. 

Boost Gymwear will not be responsible for any other washing damaged in machines where colours have been mixed. 

It is always suggested to wash colours and black especially inside out to preserve the shade from the sun. 

ORDER CANCELLATIONS

Orders may be cancelled only in the instance where the order has not yet reached the production or cutting stage.

TYPOGRAPHICAL ERRORS

In the event that an item is listed at an incorrect price or with incorrect information, Boost Apparel CC reserves the right to withdraw an item from sale, and to refuse or cancel orders.
Boost Apparel CC will make all reasonable effort to contact the customer using the details provided and all received monies will be refunded using the method received.  This means that the credit card used to purchase the goods would be the destination of any credit that may be applicable.
